Occupational Safety and Health Complaints Mechanism


Workers and employees at RSC covered factories, and their representatives, can raise safety and health concerns safely and confidentially through the Occupational Safety and Health Complaints Mechanism (SHCM), supported by a team of RSC staff specialised in investigating and resolving complaints.

Since 1 June 2020, the Occupational Safety & Health Complaint Mechanism has been operated by the RSC. Accord brand and union signatories are tasked with ensuring that the SHCM continues to provide workers with access to remedy, independently and autonomously.

During the course of investigating, RSC complaint handlers will determine the remedy/remediation requirements in regard to safety and health. The RSC team works with complainants and factory management to ensure that the requirements are fully implemented.

If factory management does not comply with the required remediation/remedy of the SHCM, the RSC will implement a notice and warning process, which may lead to the termination of the business relationship.

The Occupational Safety and Health Complaint Mechanism offers workers in the following rights:


  • The right to refuse unsafe work;
  • The right to participate in the work of their factory Safety Committee;
  • The right file a complaint when they see a safety problem in their factory;
  • The right to protection against reprisal for reporting safety-related matters;
  • The right to Freedom of Association in relation to protecting their own safety.

Description

The Complainant alleged being verbally abused and was instructed to resign from employment by the Factory Management. The Complainant's requested remedy was for Factory Management to pay his/her due separation from employment entitlements including termination benefits.

Outcome

Not processed by the RSC. Not forwarded to parties because the factory is an Accord/RSC "no brand" factory and the complaint was not specific to RSC inspections and/or remediation. The Complainant was provided with the toll free number for the Department of Inspections for Factories and Establishments (DIFE).

Description

The Complainant alleged being sexually harassed and mentally tortured by a factory manager. Allegedly the Complainant fainted and hospitalized due to the mental torture. The proposed remedy was for Factory Management to take disciplinary action against the alleged manager and pay the Complainant due separation benefits, including termination benefits.

Outcome

During the investigation, the Complainant withdrew the complaint informing the RSC that he/she does not wish to proceed with the matter.

Description

The Complainant alleged a worker was instructed to resign from employment for availing two days of sick leave. The Complainant's proposed remedy was for the worker to be reinstated at the factory.

Outcome

The RSC dispatched two members of the RSC Occupational Safety and Health Complaints Mechanism to conduct an unannounced investigation at the factory. During the factory investigation, the RSC found corroborative evidence supporting the allegation. Subsequently, the RSC confirmed that Factory Management reinstated the worker in his/her previous workstation and that he/she is continuing employment without further interruption.
